Terms of Service. By accessing or using Iron Tuna you agree to these terms. Iron Tuna is a decision-support tool for fantasy drafts; values are projections, not guarantees, and we make no representation as to results, accuracy, or availability. Season passes are one-time purchases for the stated season.
No warranties. The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability. To the fullest extent permitted by law, Iron Tuna and its owners and operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or lost opportunities, arising out of or relating to the service, even if advised of the possibility. Our aggregate liability for any claim shall not exceed the greater of the amount you paid for the service in the prior twelve months or fifty U.S. dollars (US$50).
Waiver of consequential damages. Each party waives any right to consequential, indirect, or special damages to the extent permitted by applicable law.
Indemnification. You agree to indemnify, defend, and hold harmless Iron Tuna and its owners, operators, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the service, your import or use of league data, your violation of these terms, or your violation of any third-party right or any fantasy platform’s terms.
Governing law and venue. These terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the service shall be brought exclusively in the state or federal courts located in New Hampshire, and you consent to the personal jurisdiction and venue of those courts.
You are responsible for complying with your fantasy platform’s terms when importing league data.
